Terms of Service

1. Acceptance & Eligibility

By creating an account on NumFox you agree to these Terms of Service. You must be at least 18 years old and the parent or legal guardian of any child whose profile you create. Children are beneficiaries of this service, not parties to this agreement. If you do not agree to these Terms, do not create an account.

2. The Service

NumFox is a web-based subscription service that provides daily adaptive math-facts drill exercises for children in kindergarten through Grade 3 (ages 5–9). NumFox is an educational aid designed to supplement a child's math education. It is not a diagnostic tool and does not evaluate, diagnose, or certify academic performance or any learning condition.

• Free trial: New accounts include a one-time 7-day Pro trial at no charge and without a credit card. The trial is limited to one per person and household; we may verify eligibility and deny or revoke a trial we believe is being abused.
• Pro: Up to five child profiles, unlimited daily sessions, all four operations (addition, subtraction, multiplication, and division) plus mixed-mode combo drills, every learning track, and weekly mastery reports. An active Pro subscription is required to start practice.

3. Accounts

You register using your email address. We use passwordless authentication: after providing your email, we send a magic link or a 6-digit code to that address. You are responsible for maintaining the confidentiality of your account session and for all activity that occurs under your account. Notify us at privacy@caraji.io if you suspect unauthorized access.

4. Subscriptions, Billing & Auto-Renewal

New accounts include a one-time 7-day Pro trial at no charge. After the trial, an active Pro subscription is required to use NumFox. Pro is offered in three recurring terms: $12.00 USD per 3 months, $18.00 USD per 6 months, or $24.00 USD per 12 months (billed in your local currency where applicable). Subscriptions are processed by Stripe, Inc.

Auto-renewal notice: Your subscription automatically renews at the end of each billing period at the then-current rate, unless you cancel before the renewal date. You will not receive a separate renewal reminder. You can view your next renewal date and cancel at any time from Dashboard → Plan. Cancellation prevents the next charge; it does not refund the current period.

5. Refunds & Cancellation

All payments are final and non-refundable, including automatic renewals and partial billing periods, except where a refund is required by applicable law. Every new account includes a 7-day free trial with no card required, so you can evaluate NumFox fully before any charge. When you cancel, future charges stop and your Pro access continues until the end of the current billing period; after that your account becomes inactive with read-only access to your existing history, and practice can no longer be started until you re-subscribe.

6. Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or disassemble the service;
• Use automated scripts or bots to access or scrape the service;
• Use NumFox to provide commercial tutoring services or resell access to third parties without written permission;
• Attempt to identify, contact, or interfere with other users;
• Upload or transmit harmful, illegal, or offensive content;
• Circumvent any subscription limits or authentication controls;
• Create multiple or duplicate accounts, or provide false or another person's information, to obtain additional free trials or otherwise abuse the trial, any promotion, or these Terms.

7. Intellectual Property

NumFox and all its content, design, software, and trademarks are owned by Carajillo Solutions LLC. You receive a limited, non-exclusive, non-transferable license to use the service for personal, non-commercial educational purposes. You retain all rights to any content you provide (such as a child's nickname). You grant us a limited license to use that content solely to provide the service to you.

8. Privacy & Children

Our collection and use of personal information is governed by our Privacy Policy, incorporated here by reference. Because NumFox is directed to children under 13, you confirm that you are the parent or legal guardian of every child profile you create and that you consent to our collection of limited information about your child as described in the Privacy Policy.

9. Disclaimers & Limitation of Liability

The service is provided "AS IS" without warranty of any kind. We do not warrant that the service will be error-free, uninterrupted, or that it will produce specific educational results. To the maximum extent permitted by applicable law, our total liability for any claim arising from your use of NumFox is limited to the greater of: (a) the amounts you paid in the 12 months preceding the claim, or (b) $50.00 USD. We are not liable for indirect, incidental, punitive, or consequential damages.

10. Indemnification

You agree to indemnify and hold harmless Carajillo Solutions LLC from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your account for material breach of these Terms, non-payment, or if required by law. We may also suspend or terminate any account, and revoke or deny a free trial, if we reasonably believe it is being used fraudulently or abusively, including creating multiple accounts to obtain repeated free trials or otherwise circumventing trial or subscription limits; we may take these actions without notice and without refund. Upon termination, your data will be retained for 30 days, then permanently deleted. You may delete your account at any time from Dashboard → Settings. Sections 7, 9, 10, 13, and 14 survive termination.

12. Dispute Resolution & Arbitration

Please read this section carefully. It affects your legal rights.

Any dispute arising from or related to these Terms or your use of NumFox that cannot be resolved informally shall be settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Bexar County, Texas, or by videoconference at either party's request. Each party shall bear its own costs unless the arbitrator determines otherwise.

Class action waiver: You agree to resolve disputes with us only on an individual basis. You waive any right to bring or participate in a class-action lawsuit or class-wide arbitration.

Exceptions: Either party may bring an individual claim in small claims court in Bexar County, Texas if the claim qualifies. Either party may seek emergency injunctive relief in a court of competent jurisdiction without waiving the right to arbitrate. Nothing in this clause limits rights that Mexican consumers may have under applicable Mexican consumer protection law (LFPC / PROFECO).

To initiate arbitration, send written notice to privacy@caraji.io. We will attempt informal resolution for 30 days before arbitration begins.

13. Governing Law & Venue

These Terms are governed by the laws of the State of Texas and applicable federal law of the United States, without regard to conflict-of-law principles. For any dispute not subject to arbitration, the exclusive venue shall be the state or federal courts of Bexar County, Texas.

14. Changes to These Terms

We may update these Terms. If we make a material change, we will notify you by email at least 30 days before the change takes effect. Continued use of the service after the effective date constitutes acceptance. The current version is always available at numfox.app/legal/terms.
